1. What is and isn't required by law


In Spain there's no legal obligation to take out specific civil liability insurance for bicycle rental. Unlike motor vehicle hire, where insurance is legally mandatory, bicycles fall outside that framework.


What may be required depending on the council or regional government is general business civil liability insurance as part of the opening or activity licence. Check the regulations in your municipality.


2. Why have insurance even when it's not required


The two most frequent scenarios during peak season are theft and accidental damage. A bike stolen during a rental (even with a lock) or damaged in a fall can represent €300 to €2,500 in direct loss.


Without insurance, that cost is yours. With fleet insurance, depending on the policy terms, it may be fully or partially covered.


A less frequent but more costly scenario is a civil liability claim: a customer who has an accident and alleges the bike had a defect. Without coverage, that kind of claim can have significant consequences.


3. What fleet insurance for bikes covers


The most common coverage types are:


Total theft. The bike disappears during the rental period. Some policies require a specific type of lock or include an excess.


Accidental damage. The bike is damaged in a fall or collision during the rental. Covers repair or replacement value depending on the extent of damage.


Civil liability. The business is covered against third-party claims for damage caused by the bikes or during their use.


Not all policies include all three. Read carefully what yours covers and what the excess is.


4. What to ask before taking out a policy


Before taking out fleet insurance for rental bikes, ask:



  • Does it cover theft during the rental (when the bike is away from my premises)?

  • What is the excess per claim?

  • Does it cover electric bikes at the same price or is there a surcharge?

  • Is the insured value the purchase price or current market value?

  • Is there a claims limit per season?


Look for brokers who specialise in tourism businesses or bike fleets. Generic commercial insurance often has exclusions that aren't obvious until a claim arises.

Does the customer's deposit cover bike damage?
The deposit covers damage the customer admits to or that is documented in the contract. For damage the customer denies, or for theft, the deposit doesn't help. That's what insurance is for.


Do I need to insure each bike individually?
No. Fleet insurance covers the whole fleet under a single policy, with a total insured value or a maximum per unit. It's more efficient than insuring each bike separately.


Does insurance cover if a customer takes the bike and doesn't return it?
It depends on the policy. Some insurance covers theft by the renter (conversion), others don't. Ask the broker explicitly.
